Ahmadlou: Conflict management will increase public trust interests

An expert on legal issues said that if the bill on conflict of interest management in public services is approved, it will increase public trust in the political and administrative system.

In an interview with ISNA, Nabiullah Ahmadlou stated on the issue of conflict of interest: Conflict of interest refers to the situation, situation and situation in which an individual or organization and institution encounters different interests and is in a situation where each of them Interests can corrupt the right decision of that person or organization and institution.

He added: “These are different interests and can be financial, emotional, partisan and national, and even include family and other issues.”

The legal expert explained: “One of the most important principles in public law is the need to respect the public interest, which should be considered by officials, agents of agents and employees in the public sector and even in private institutions that provide services to the public.” . These duties are legislative in the Islamic Consultative Assembly and are executive in government agencies and are very important in public institutions that include public services.

Ahmadlou continued: “According to this principle of partisanship, discriminatory and intentional behavior or disregard for public rights is considered ugly and its observance in law is very important.” In fact, public law takes into account the public interest, the interests that government and non-governmental organizations and public and private institutions serve the people of the community, and the principle of public interest takes precedence over all the interests that are in principle conflict of interest.

He stressed: “The place of the bill or the conflict of interest law in our laws was very much felt and necessary, and one of the progressive principles that can affect the health of government and non-government agencies in providing services and respecting the public interest has been empty.” Therefore, this bill started in the end of 1995 in the legal section of the presidency, and in the opinion of the bill presented by the government, it is somewhat a good bill, and now it has reached the parliament, and apparently the parliament has also prepared a plan.

The legal expert pointed out that the bills presented by the government are more comprehensive than the plan submitted by the parliament, because the parliamentary commissions are not considered in the plan of the parliament, and in the same parliament, many decisions are made that do not respect the public interest. For example, in the medical or economic commission, there are people who have interests and are physicians, and in the observance of interests, they usually have a conflict of interest, which seems to be a conflict in the commissions and even in the parliament.

Ahmadlou reminded: “Even in the past, we have seen, for example, a plan that has the rights of permanent representatives, which shows that they have considered the interests of individuals, while these proposals and plans are not compatible with the public interest.”

“The bill presented by the government is more comprehensive,” he said. “It seems that more expert work has been done on it and the opinions of professors and thinkers have been taken, and it will be one of the important priorities of the parliament to address this issue in the future.” We hope that with the legalization of this bill, the public interest will prevail in the society and it will prevent the corruption that is observed in many decisions of governmental and non-governmental bodies.

“If the conflict of interest management bill in the public service is passed, it will boost public confidence in the political and administrative system and prevent many of the decisions that government officials make,” he said. It will even have an impact on legislation and increase people’s trust and enforcement of the law.

Ahmadlou said: “We hope that with an expert review and integration of the parliament and government bill, a law will be passed that can firstly create transparency in the decisions of government, administrative, legislative and judicial bodies and on the other hand create public trust for decisions in society and interest and enthusiasm.” Increase the implementation of laws and decisions of government agencies in society.

He pointed out: “In the matter of conflict of interest of developed countries, especially the Europeans, they have been far ahead of us and in this regard, they have laws that are observed.” Of course, in the laws of Iran, there are some of these cases, such as the civil law and the law of civil affairs, including the observance of the law of lawyer and client, guardian and minor, guardian and custodian, etc., but a comprehensive law that can initially give public confidence in To attract government agencies and, more importantly, the interests of individuals and persons take precedence over the public interest, and the implementation of public interests overrides the interests of individuals is very necessary and its vacancy is felt.

In the end, the lawyer said: “We hope that the parliamentary amendments to this bill will create transparency in the society and prevent rent-seeking and corruption.”
