According to Tejarat News, Hassan Rouhani said at the conference on constitutional rights and citizenship that “the votes of the people play a very important role, but unfortunately in our country we do not have a party system.” Do not work hard. This means that with the controversy and noise close to the elections and various slogans, it may be a little difficult to guide the people to choose who and whom to elect.

He continued: “But if it is a party system, it is easier.” In the party system, they constantly define the dialogue and the framework. Our system and constitution is not a party and is not based on the party, that is, in elections we vote for the individual, we do not vote for the party, it wants to be the parliament or the city council or the experts. We do not have a party filter in the presidency either.

Rouhani emphasized: In any case, every country has filters in the elections, we do not have a party filter. This filter is applied through the Guardian Council and it is not a party and we have such problems that we have to think about them.

Emphasizing that there is no problem in discussing the revision of the constitution when it is needed, the president said: “The constitution is usually amended late in the world.” The constitution has not been changed for 31 years. Previously, 10 years after the demise of Imam Khomeini, the constitution was amended. But the constitution has not changed in 31 years and may change some time.

He reminded: One of the issues that has no place is whether it is good for the party system to be included in the constitution or not? When we were discussing the election law in the diagnostic assembly, we approved a framework in the commission that was stopped for some reason at that time. In the court of the Assembly, 4 articles were approved and then stopped. In that general policy framework, we envisioned a party system in which people could vote for the party instead of the individual.

Rouhani emphasized that our constitution is one of the most significant constitutions in the world and we can be proud of it, adding: It is clear and the principles are clear and modern, it is something that can be presented in the world as a modern constitution.

The president said: “Unfortunately, not everyone understands the constitution in the same way. Of course, the law stipulates that if a part of it needed to be interpreted, what institution should do the necessary interpretation.” But before we get to the interpretation of the law, it is very important to understand what we understand and understand from this constitution.

Emphasizing that the pillars of the government, namely the government, the parliament and the judiciary, do not have a common understanding of the constitution, he clarified: the powers do not think alike and there may be disagreement on technical and important issues. Because sometimes we hear some members of parliament say that we should monitor the work of ministers, which is a sign of an incomplete interpretation of the constitution.

Rouhani stated that of course the deputies may ask the ministry in a sense, but there is no law in the supervision of the work of ministers, he said: it is the president who supervises the work of the minister. In other words, overseeing the work of a minister is one of the duties of the president, and the president resolves disputes between two ministers, and coordination between two ministers or several ministers is the responsibility of the president.

Recalling that the parliament can put interpellation on the agenda where it deems it appropriate, the president said: Has not been.

“Our understanding of the law is not the same,” he said. “Who should write the program for the government?” Of course, during the previous regime, a five-year plan and similar was written as an example, but in the Islamic Republic and the plan according to Article 134 and the implementation of the law is the responsibility of the President and it is explicitly stated in the law that When the plan and policy is the responsibility of the president, we have to set the plan several times.

Rouhani reminded: “When the president determines the necessary program to be elected, he presents the program in the elections and announces his plans in interviews with the people and in the communities.”

The President continued: Article 134 of the Constitution states that it is the responsibility of the President to determine the policy and the parliament approves the five-year plan. It is important to understand how such issues are combined. According to this constitution, law professors and jurists must think and comment on the issues that are disputed, and this should be discussed and cooked, and we should reach a consensus on these issues.

He said that the very important point of the constitution is who is responsible for the implementation of the constitution? He emphasized: Article 113 of the Constitution has several issues; First, he defines the position of the president and says that the president is the second official of the country and the highest official of the country after the leadership is the president. Immediately after this, he says that he is responsible for implementing the constitution. Is responsible and except for the cases that are of course the responsibility of the leadership.

He added: “This issue is very clear and transparent.” When this law is read first and last, it means that the president in the executive branch is responsible for the implementation of the constitution. Saying this is null and void, it is clear that everyone in his department is responsible for enforcing the law, there is no need to say this. This word is meaningless and meaningless! This is one of the places that does not require interpretation and there is no difference of opinion in this regard.

Referring to the different interpretations of some of Article 134 of the Constitution, Rouhani said: The Guardian Council in its final interpretation has an interpretation that is an important issue. Of course, there was a different perception there in the early periods of the revolution, lawyers should think about this issue. They interpret differently in each term, otherwise the Guardian Council may offer a different interpretation in another term.

Referring to the position of the referendum in the constitution, the President stated: Article 59 of the Constitution can be important in times when there is a fundamental disagreement and there is no consensus. Of course, it must be an important issue to be discussed and put to the public vote and put to a referendum. Of course, the mechanism of this principle is very complex, but after 40 years it can be implemented once.

In another part of his speech, he stated that one of the promises I made to the people was citizenship rights: I said to announce the Charter of Citizenship Rights and announce it to the people. Friends drafted several times before I met with a number of lawyers. They asked, “What is your basis for writing the Charter of Citizenship and where do you want to write it?” Is this a bill or a bylaw?

Rouhani continued: There was a lot of discussion. I said that the basis is Article 134 of the Constitution and then it can be turned into a bill. Many meetings were then held to draft a revised charter for which individuals were responsible.

Emphasizing that he did not see anyone making major changes to the charter, the president said: “Some may say that a few more articles need to be added to it, but in the end it is a revised charter and the reason it was drafted was for people to know their rights.” What is it and let the executive officials of the country and other officials know that these rights and duties exist.
